2. Description of Service
Flydo provides a platform for creating, deploying, and managing AI-powered conversational agents across multiple channels including websites, messaging platforms, and custom integrations. Our Service includes:
- AI agent creation and configuration tools
- Multi-channel deployment (WhatsApp, Telegram, Slack, Discord, etc.)
- Knowledge base management and RAG capabilities
- Analytics and conversation insights
- API access and custom integrations
3. Account Registration
To use our Service, you must:
- Be at least 18 years of age
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Promptly notify us of any unauthorized access
- Accept responsibility for all activities under your account
4. Acceptable Use
You agree not to use our Service to:
- Generate harmful, abusive, or misleading content
- Impersonate humans without clear AI disclosure
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Distribute malware or engage in phishing
- Spam or send unsolicited communications
- Attempt to reverse engineer our AI models
- Circumvent usage limits or security measures
- Process sensitive data without appropriate safeguards
5. AI Usage and Limitations
Our AI-powered agents are designed to assist with conversations but may not always be accurate. You acknowledge that:
- AI responses may contain errors or inaccuracies
- Human oversight is recommended for critical decisions
- You are responsible for reviewing AI-generated content
- AI should not replace professional advice (legal, medical, financial)
6. Subscription and Payments
Billing: Paid plans are billed monthly or annually in advance. Prices are exclusive of taxes.
Usage Limits: Each plan includes specific limits on agents, messages, and features. Exceeding limits may result in overage charges or service restrictions.
Refunds: We offer a 30-day money-back guarantee for new subscriptions. After this period, refunds are at our discretion.
Cancellation: You may cancel your subscription at any time. Access continues until the end of the billing period.
7. Intellectual Property
Our IP: The Service, including all software, AI models, designs, and documentation, is owned by Flydo and protected by intellectual property laws.
Your Content: You retain ownership of your data, conversation flows, and knowledge base content. You grant us a license to use this content solely to provide the Service.
Feedback: Any feedback or suggestions you provide may be used by us without obligation to you.
8. Data Processing
Our processing of personal data is governed by our Privacy Policy. For enterprise customers, we offer Data Processing Agreements (DPA) and Business Associate Agreements (BAA) upon request.
9. Third-Party Services
Our Service integrates with third-party AI providers (OpenAI, Anthropic, Google) and messaging platforms. Your use of these integrations is subject to their respective terms and policies. We are not responsible for third-party service availability or performance.
10. Service Availability
We strive for 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance with reasonable notice. We are not liable for downtime caused by factors beyond our control.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Flydo SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless Flydo from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these terms.
13. Termination
We may suspend or terminate your access for violation of these terms. Upon termination, your right to use the Service ceases immediately. You may export your data within 30 days of termination.
14. Changes to Terms
We may update these terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.
15. Governing Law
These terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
